Gift Card Terms and Conditions

These Gift Card Terms and Conditions apply to the purchase and use of Lush South Africa gift cards.

1. About these Terms

1.1 These terms and conditions (“Terms”) govern the purchase and use of gift cards purchased from a Lush South Africa retail store, or Rand-denominated electronic gift cards purchased from www.lush.co.za (“Lush Gift Cards”).

1.2 Lush Gift Cards are issued by Green Bubbles Cosmetics t/a Lush Fresh Handmade Cosmetics, a company registered in South Africa under registration number 2011/144303/07, with its registered address at Shop 7104, Victoria Wharf, Victoria & Alfred Waterfront, Cape Town, 8001 (“Lush”, “we”, “us” or “our”).

1.3 Gift cards or vouchers not issued by a Lush South Africa retail store or through www.lush.co.za are not covered by these Terms. Please contact the relevant card or voucher issuer for support relating to delivery, use, redemption or customer care.

2. Purchase

2.1 Lush Gift Cards are available for purchase from participating Lush South Africa retail stores (“Store Gift Cards”) and/or online at www.lush.co.za (“e-Gift Cards”), subject to availability.

2.2 Lush Gift Cards are issued in South African Rand.

2.3 Lush Gift Cards may be purchased with a minimum value of R100 and a maximum value of R2,500. Gift Cards are sold in increments of R50.

2.4 Lush Gift Cards cannot be purchased using another Lush Gift Card.

3. Redemption

3.1 Lush Gift Cards are redeemable only at participating Lush South Africa retail stores and/or at www.lush.co.za.

3.2 Lush Gift Cards may be used to pay for the full value or part of the value of eligible Lush products.

3.3 Lush Gift Cards cannot be redeemed on any Lush website outside South Africa, including but not limited to www.lush.co.uk, www.lush.com, or any third-party website.

3.4 Lush Gift Cards may not be exchanged for cash or credit, except where required by applicable law.

4. In-store Payment

4.1 A Store Gift Card must be presented at the time of payment in store.

4.2 Any reasonable number of Lush Gift Cards may be used to pay for purchases in store, subject to system limits and fraud-prevention checks.

5. Online Payment

5.1 For purchases made online, the Lush Gift Card number and/or code must be entered at checkout.

5.2 Lush may limit the number of e-Gift Cards that can be redeemed per online transaction, depending on the functionality available at checkout.

5.3 If you experience any issues when attempting to redeem an e-Gift Card online, please contact our Customer Care team at info@lush.co.za.

6. Balance and Expiry

6.1 The balance of a Lush Gift Card will reduce as it is used.

6.2 Lush Gift Cards will remain valid until the earlier of:

a) the date on which the full value has been redeemed; or
b) three years from the date of issue, unless Lush agrees to a longer period.

6.3 Any remaining balance on a Lush Gift Card will not be refunded in cash, except where required by applicable law.

6.4 To check your Lush Gift Card balance, please contact our Customer Care team at info@lush.co.za or visit a participating Lush South Africa retail store. If online balance-checking is available, it may also be accessed via www.lush.co.za.

7. Returns

7.1 Returned purchases paid for in full or in part with a Lush Gift Card will have the amount originally paid by Lush Gift Card refunded to a new or existing Lush Gift Card, unless otherwise required by applicable law.

7.2 Returns remain subject to Lush South Africa’s returns policy and applicable South African consumer protection laws.

8. Lost, Stolen or Damaged Gift Cards

8.1 Lush Gift Cards should be treated like cash.

8.2 Lush is not responsible for lost, stolen, damaged or unauthorised use of Lush Gift Cards, unless this is due to Lush’s own error or negligence, or where otherwise required by applicable law.

8.3 Lush Gift Cards are not cheque guarantee cards, credit cards, charge cards or debit cards.

9. Limitations

9.1 Lush Gift Cards may not be used to purchase other Lush Gift Cards.

9.2 Lush Gift Cards may not be resold, transferred for value, exchanged for cash, or used for any unlawful purpose.

9.3 Lush reserves the right to cancel or refuse to honour a Lush Gift Card where we reasonably suspect fraud, abuse, unlawful activity, unauthorised resale, or a breach of these Terms.

10. Customer Service

10.1 If you need assistance with any aspect of your Lush Gift Card, please contact our Customer Care team at info@lush.co.za or visit your nearest Lush South Africa retail store.

10.2 Please include your order number, gift card number, recipient email address, or any other relevant information that may help us assist you.

11. Delivery of e-Gift Cards

11.1 e-Gift Cards are delivered by email to the email address provided at checkout.

11.2 If the recipient has not received the e-Gift Card within a reasonable period after purchase or the selected delivery date, please check whether:

a) the email was routed to a spam, junk or promotions folder;
b) the recipient’s mailbox is full;
c) the recipient’s firewall or email settings blocked the email; or
d) the email address provided at checkout was incorrect.

11.3 If you need further assistance, please contact our Customer Care team at info@lush.co.za.

11.4 e-Gift Cards received in error may be cancelled by Lush.

12. Changes to these Terms

12.1 To the extent permitted by applicable law, Lush may update these Terms from time to time.

12.2 The latest version of these Terms will be made available on www.lush.co.za or can be requested from our Customer Care team at info@lush.co.za.

12.3 Changes to these Terms will not reduce any rights you have under applicable South African consumer protection laws.

13. Liability

13.1 To the extent permitted by applicable law, Lush’s liability to the bearer of a Lush Gift Card in relation to these Terms will not exceed the remaining balance of the Lush Gift Card at the date the liability arose.

13.2 Nothing in these Terms excludes or limits Lush’s liability where such liability cannot be excluded or limited under applicable law.

14. Severability

14.1 If any provision, or part of a provision, of these Terms is found by a court or other competent authority to be illegal, invalid or unenforceable, that provision or part-provision will be treated as removed from these Terms.

14.2 The remaining provisions will continue to apply.

15. Governing Law

15.1 These Terms are governed by the laws of the Republic of South Africa.

15.2 Any disputes or claims arising in connection with these Terms will be subject to the jurisdiction of the South African courts.
